For the purposes of these Terms of Use, “USER” will be understood as any person who accesses the Website or uses the services contained or associated with it through a device with Internet connection.

On the Website, the USER will be able to browse the different contents made available by BRUDY LAB, S.L. and especially get to know the variety of our products in medical nutrition based on the benefits provided by DHA for human health, which may be acquired through the online store of the Website.

If so desired, the USER may register with their own personal account in order to carry out the purchase process and may, when requested, also receive updated information on new products, promotions or events that may be of interest to them.

BRUDY LAB, S.L. reserves the right to complete, update and/or modify these Terms of Use, the Privacy Policy and/or the Terms and Conditions, in which case the USER will be informed in advance before proceeding to their acceptance or rejection, should they turn out to be substantial or to affect the USER individually.

The access or navigation through the Website by the USER implies their acceptance of all the Terms established in these Terms of Use and those related to the Privacy Policy. Any use of the Website shall be deemed subject to these Terms of Use, regardless of whether the USER is registered or not.

Browsing the Website is free of charge to the USERS (without prejudice to any fees to which said USERS may be subject as a result of the data traffic on their device/s and which may be invoiced to them by their own Internet provider.

The products that can be purchased in our online shop are subject to the prices and the rest of conditions expressly displayed on the Website.

The Website offers an area reserved for USERS who wish to register with a private account, which can be accessed once the registration procedure has been completed.

The private account registration is personal and non-transferable. Only natural persons of legal age who have not been legally incapacitated are allowed to register.

The accounts of the USERS registered on the Website are private.  Creating a private account on the Website requires the USER to provide an identifier (email address) and a password chosen by the USER.

Through their private account the USERS can consult and modify the billing data for all orders, delivery addresses, payment methods, purchase history and other information or preferences that allow personalizing the shopping experience.

To transmit accurate and truthful information, especially regarding courtesy treatments, surnames, name, email address and telephone number, or other information that may be necessary for the correct identification of the USER and the proper delivery of purchased products after completing a purchase process.

To notify BRUDY LAB, S.L. of any modification that affects the data provided and to ensure their veracity and accuracy.

BRUDY LAB, S.L. reserves the right to verify the accuracy of the data provided by the USER and to take the corresponding legal action, including the right to deny or cancel registration of a USER, or to unsubscribe them if BRUDY LAB, S.L. suspects that false or incomplete data have been provided.

BRUDY LAB, S.L. will not be held liable, neither directly nor indirectly, for the malicious or fraudulent use of the Website by the USER, in which case it would be the latter who shall respond for the damages, consequences or actions which may arise from such use.

The USER undertakes to use the services and contents provided by the website in an appropriate and responsible manner and not to use them in order to carry out illegal or criminal activities that violate the rights of third parties, the regulation on intellectual and industrial property or any other norms of the applicable legal system. Specifically, the USER undertakes:

Not to use the Website to transmit, introduce, disseminate or bring to the public any type of material and information that could infringe rights or freedoms of third parties;

For any matter not expressly addressed in this document, all rights on said matters are reserved in favour of BRUDY LAB, S.L. and such rights shall only be carried out with written authorization from BRUDY LAB, S.L.

Should the USER or any third party consider certain elements or contents of the Website are violating their own industrial or intellectual property rights, image rights or other rights of a similar nature, they may contact BRUDY LAB, S.L. through the contact information appearing in the heading, providing all necessary information that justify their eventual ownership or the existence of the alleged violation of their rights or those of third parties. BRUDY LAB, S.L. has among its priorities that the Website is accessible from any kind of device and regardless of the operating system or version USERS may be using. These conditions are subject to Spanish law especially and without limitation, to the provisions of Law No. 34/2002 of July 11, 2002 on Information Society Services and Electronic Commerce (LSSICE), the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, Law 7/1998, of April 13, on General Contractual Conditions, Law 7/1996, of January 15, on Retail Trade, Royal Decree 1487/2009, of September 26,  on Food Supplements, which transposes Directive 2002/46/EC  which establishes the regulatory framework at European level, Regulation (EU) 2016/679, of the European Parliament and of the Council, of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data already the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation, RGPD), with its respective amendments in all cases, and the rest of the legislation of a general nature or of subsidiary application in conformity with the basic principles of organisation the Spanish legal system.

For any question regarding the validity, interpretation or execution of these conditions, the parties submit themselves to the Spanish Courts which, in accordance with the applicable regulations, and especially those referring to consumers and users, will be applicable; and failing this, and only in the case there is no mandatory rule on territorial jurisdiction, the parties submit to the courts of the domicile of BRUDY LAB, S.L.
